What is Graffiti?

The term ‘Graffiti’ generally refers to illegally defacing private and public property with markings and/or graphics without the owners consent. Graffiti can take multiple forms including designs, words or images using chalk, paint, scratching, textas, acid etching or other material such as stickers and billposters.

What's New?

Legislation regulating the display of spray paint cans

The Summary Offences Amendment (Display of Spray Paint Cans) Act 2006 commenced on 1 November 2006. The Act aims to reduce the amount of graffiti in the community by reducing the theft of spray paint cans.

In order to do this, the Act and its accompanying regulation require retailers who sell spray paint cans to keep those cans either:
  • In a locked cabinet
  • In or behind a counter in such a way that customers cannot gain access to the cans without the assistance of shop staff
  • On a shelf of height 2.1 metres or more or
  • In any other manner prescribed by the regulations.

Spray paints which are colourless and transparent are exempt from the Act.

A retailer who fails to comply with the Act may face a fine of up to $1,100.

While the Act commenced on 1 November 2006, a ‘grace period’ will be provided until 1 February 2007. During the grace period the Office of Fair Trading will focus on providing retailers with education and assistance to help them comply with the legislation, rather than on enforcement action.
